1. Who this agreement is between
PulseSpot is run from Johannesburg, South Africa by its founder, Bongani Ndelu (“PulseSpot”, “we”). “You” means the venue business. Whoever accepts these terms confirms that they are authorised to act for the venue.
2. Listings and claims
- Listings start from OpenStreetMap and the community. Claiming your listing is free. We confirm every claim with the venue on its own public contact details before approving it.
- Keep your details accurate. Tell us if your venue closes or moves. You can ask us to correct or remove your listing at any time.
- A listing doesn’t mean PulseSpot endorses or is connected to your venue, and we may correct, hide or remove listings that are wrong, unsafe or unlawful.
3. Table and VIP requests
- You decide which requests to accept, and you must honour the bookings you confirm.
- Guests share their name, phone number and booking details with you only to handle their booking. You are responsible for that information under POPIA: keep it secure, don’t use it for marketing unless the guest agrees, and delete it when you no longer need it.
4. Deposits (optional)
- Payments. Deposits are processed by Paystack, a registered payment provider. Your payout account is a Paystack subaccount, and you agree to Paystack’s terms for it. The bank account must belong to the venue’s business. PulseSpot checks each new or changed payout account with the venue before deposits can be switched on.
- Amounts. You set one deposit for tables and one for VIP, from R50 to R10 000. Say in your booking note how the deposit is used, for example taken off the bill. Your own rules must not contradict the refund rules below.
- How the money moves. A guest pays only after you accept their request, and the booking is confirmed once they’ve paid. Paystack splits each deposit when it is paid: PulseSpot’s service fee of 10% of the deposit goes to PulseSpot, and the rest goes to your bank account on Paystack’s payout schedule. Paystack’s transaction fee comes out of your share. PulseSpot never holds your share.
- Unpaid deposits. If a guest doesn’t pay by the deadline shown to them, the request expires and the table is yours to give to someone else.
- Cancellations and refunds. If the guest cancels at least 24 hours before the booking, they get a full refund. If they cancel later or don’t arrive, you keep the deposit as a cancellation fee. If you cancel, the guest gets a full refund. PulseSpot may also refund a guest in full where the law requires it, to settle a dispute, or to correct a mistake.
- Who pays for refunds. Paystack pays refunds from PulseSpot’s balance, because your share may already be in your bank. You owe PulseSpot your share of each refunded deposit (the deposit less PulseSpot’s fee). We recover it from your next deposits, and you always keep at least half of each deposit, or we may invoice you for amounts still owed after 60 days.
- Disputes and chargebacks. If a guest’s bank reverses a payment because a booking wasn’t honoured, your share of that payment is yours to repay in the same way, and you agree to help us answer the dispute.
- Tax. You are responsible for tax on your share. PulseSpot’s fee is PulseSpot’s income.
5. Featured and club profiles
- What Featured is. A Featured spot is shown first in the spot list near it (up to three Featured spots lead the list) and shows its deal on its card. Featured spots are always labelled “Featured”, as the advertising code requires. We don’t promise any number of visits or bookings.
- Price and payment. Featured costs R1 500 for 30 days or R15 000 for 365 days, paid up front through Paystack (card or EFT) into PulseSpot’s account. The price is shown before you pay. The first 20 venues to buy Featured pay half on every purchase made within 6 months of their first payment, and the full price after that.
- No automatic renewal. Featured ends at the end of the period you paid for unless you buy more. Days you buy before then start when your current period ends.
- Ending early. We may end Featured early, or remove a club profile, if your listing breaks these terms, the Community Rules or the law. If we end it for a reason that isn’t your fault, we refund the unused days. Nothing here limits your rights under the Consumer Protection Act.
- Club profiles. Your deal (up to 80 characters), about text, hours, Instagram name and up to 3 photos show on your spot, as plain text; the deal only while you’re Featured. Keep them true and up to date, use only photos you have the right to use, and only show people who are happy to be shown.
- Responsible deals. Deals are for people 18 and older. Don’t offer unlimited, bottomless or free-flowing drinks, drinking games or anything else that encourages heavy drinking, and don’t aim deals at people under 18.
6. Your responsibilities
- Follow the law that applies to your venue, including your liquor licence conditions, not serving or admitting people under 18 where the law says so, health and safety rules, and the Consumer Protection Act.
- Don’t post misleading offers or prices, and don’t discriminate unlawfully against guests.
7. Our responsibility
We provide PulseSpot “as is” and work to keep it available, but we can’t promise it will always be uninterrupted or error-free. As far as the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the fees you paid PulseSpot in the three months before the claim.
8. Ending
You can stop taking requests or deposits, or ask us to remove your listing, at any time. We may suspend venue tools for fraud, misuse or a breach of these terms. Amounts owed under section 4 stay owed after either of us stops.
9. Changes and law
We may update these terms and will tell verified owners about important changes before they apply. South African law governs these terms, and South African courts have jurisdiction. Contact us through the contact page.
